  • CR2 and IR2 visas are intended for minor children of foreign nationals whose parents have CR1 or IR1 status in the United States. Here's who can apply for these visas:

Children included in the CR1 or IR1 visa petition: If a parent with CR1 or IR1 status petitions for a visa for their spouse, their minor children can be included in that petition. This means they can obtain CR2 or IR2 visas and enter the United States together with their parents.

Children included in the I-130 petition: If one of the parents is a U.S. citizen and files an I-130 petition for the immigration of their child who is residing abroad, that child can obtain an IR2 visa.

It's important to remember that minor children receiving CR2 or IR2 visas must be unmarried and not in official marriages.

  • Unfortunately, CR2 and IR2 visas are only intended for minor children (under 21 years of age) of U.S. citizens who wish to reunite with their parents. If your child is over 21 years old, they can no longer use these visa types.

Instead, there are other immigration categories for reuniting with adult children, such as F2B visas (for unmarried adult children of U.S. citizens or LPRs over 21 years old) or F3 visas (for married adult children of U.S. citizens), among others. These categories may involve long waiting times and have their own specific requirements and conditions.

  • Green card holders (permanent residents of the United States) cannot use the CR2 and IR2 visas for their children. These types of visas are intended for children of U.S. citizens. For the children (minors) of green card holders who are not yet U.S. citizens, the F2A visa category is used. The F2A visa is for minor children (under 21 years old) and spouses of green card holders who wish to reunite with the primary green card holder in the United States.

This process requires filing an I-130 petition, which the primary petitioner (green card holder) must file on behalf of their child (or spouse) with USCIS. After the petition is approved and visa numbers are available, family members can apply for visas and reunification at the U.S. consulate or embassy in their home country.

  • The question of which type of visa is better - K-2 or CR-2, depends on the specific situation and circumstances of the family planning to reunite in the United States. Both types of visas have their own features and limitations. For example, if your child is already 18 years old (but not older than 21) and you are only planning to get married, then it is preferable to choose the K-2 visa, as the child will have the right to obtain a visa along with the parent.

    Let's compare their main characteristics:

    K-2 Visa:

    Family Relationship: K-2 is a non-immigrant visa for unmarried children of a U.S. citizen's fiancé(e) who holds a K-1 visa.

Application Process: The parent with a K-1 visa must include their child in the K-1 petition and file a separate application for the K-2 visa after the K-1 petition is approved.

Limitations: The K-2 visa is valid for entry into the United States and staying together with the U.S. citizen parent (with a K-1 fiancé(e) visa). It can also be used for attending school in the U.S. To obtain a green card, the child needs to go through the adjustment of status process within the U.S.

    CR-2 Visa:

Family Relationship: CR-2 is an immigrant visa for unmarried children of U.S. citizens or their spouses.

Application Process: A U.S. citizen can file an I-130 petition (Petition for Alien Relative) for their child, and after the petition is approved, the child can apply for the CR-2 immigrant visa.

Limitations: The CR-2 visa grants the child permanent resident status in the United States, which means the right to permanent residence and work in the U.S. The child receives a green card upon arrival in the U.S.

The choice between the K-2 and CR-2 visas depends on your family's situation and future plans.

  • Yes, typically a child applying for a CR2 visa (for children of U.S. citizens) or an IR2 visa (for children of green card holders) will need to undergo a medical examination before the U.S. embassy or consulate interview. The medical examination is conducted by a physician approved by the U.S. embassy or consulate in your country.

    The medical examination typically includes:

    1. Physical examination.

    2. Vaccinations and/or verification of required vaccinations.

    3. Testing for infections, such as tuberculosis.

    4. Chest X-ray.

After the medical examination, the physician will provide the results, which will need to be presented to the U.S. embassy or consulate along with other required documents during the interview.

  • Yes, usually the child is required to be present at the visa interview. However, there are exceptions to this rule. To get specific information for your case, you should contact the consulate where the visa interview will be conducted.
