Requirements for CR-1 and IR-1 visas, U.S. citizen spouse visas, are aimed at confirming legitimate marriages and relationships. Here are the main requirements:

  • Legitimate Marriage: You must be legally married to a U.S. citizen. For the CR-1 visa, the marriage must be less than two years old, and for the IR-1 visa, it must be more than two years old.

  • Evidence of Relationship: You must provide evidence of genuine and bona fide relationships, such as cohabitation, joint finances, photos together, correspondence, and others.

  • Compliance with Visa Requirements: You must meet the general requirements for obtaining a U.S. visa, such as no criminal record, medical examination, etc.

  • Financial Support: The U.S. citizen must provide evidence of official income sufficient to support the spouse after arrival in the U.S.

The difference between these visa types lies in the fact that for the CR-1 visa, the marriage must be less than two years old, whereas for the IR-1 visa, the spouses must be married for more than two years.

If during the processing of the petition for a CR-1 visa (spouse visa), the marriage becomes more than two years old, the visa category will be changed to IR-1.

The CR-1 visa is a Conditional Resident Visa, subject to the condition of a temporary green card. It subsequently requires the removal of "conditional" status and replacement with a 10-year green card.
